FGTS birthday withdrawal: is it worth opting in? Rules and risks

Short answer: it depends on your goal. The birthday withdrawal (saque-aniversário) is an optional FGTS mode that lets you withdraw part of your balance once a year, in your birthday month. It makes sense for people who need extra cash each year and have job stability. But there's an important cost: anyone who opts in and is later dismissed without just cause can only withdraw the 40% severance fine, not the full balance — and switching back to the standard mode requires a waiting period of roughly two years.

⚠️ Educational content only; this is not individual advice on opting in or taking an advance loan.

Note: the FGTS is Brazil's government-managed severance savings fund for workers. This article keeps the Brazilian rules and official sources, since the program only exists in that context.

What the birthday withdrawal is

Created by Law 13.932/2019, the birthday withdrawal is an optional FGTS withdrawal mode. Those who opt in can withdraw a percentage of their balance once a year, in their birthday month, according to the annual calendar published by the government. Those who don't opt in remain in the default mode, the termination withdrawal (saque-rescisão), in which the full balance can only be withdrawn in specific situations set out in art. 20 of Law 8.036/1990 — such as dismissal without just cause, retirement, serious illness, or use for housing.

Table: how much you can withdraw

Illustration of the FGTS balance brackets used in calculating the birthday withdrawal

The rate ranges from 5% to 50% depending on the balance bracket, plus a fixed additional amount:

Balance bracket Rate Fixed additional amount
Up to R$ 500 50% —
R$ 500.01 to R$ 1,000 40% R$ 50
R$ 1,000.01 to R$ 5,000 30% R$ 150
R$ 5,000.01 to R$ 10,000 20% R$ 650
R$ 10,000.01 to R$ 15,000 15% R$ 1,150
R$ 15,000.01 to R$ 20,000 10% R$ 1,900
Above R$ 20,000 5% R$ 2,900

Example: with a combined FGTS balance of R$ 1,000, the withdrawal would be 40% of R$ 1,000 (R$ 400) + R$ 50 = R$ 450. With a balance of R$ 30,000, it would be 5% + R$ 2,900 = R$ 4,400.

The calculation uses the combined balances in all linked FGTS accounts. See the official FGTS table of rates and additional amounts.

The main risk: losing access to the balance if you're dismissed

This is the main trade-off. If you have opted into the birthday-withdrawal mode and are dismissed without just cause, you generally can access the dismissal compensation payment (multa rescisória), not the remaining FGTS account balance by reason of that dismissal. This also applies if you have already requested to change back but the birthday-withdrawal mode is still in effect.

The usual dismissal compensation payment is 40% where applicable; the remaining FGTS balance may still be accessed through future annual withdrawals or other legally authorized circumstances.

Special release already completed in 2026: Brazilian Provisional Measures (MPs) No. 1,331/2025 and No. 1,355/2026 authorized an exceptional release of eligible balances for workers whose employment ended between January 1, 2020, and December 23, 2025, while birthday withdrawal was in effect. Payments under the specific schedules were completed by June 1, 2026. This did not change the worker's withdrawal mode or extend to dismissals after December 23, 2025. Read the official FGTS explanation of the exceptional release.

How to switch back to the termination withdrawal

You can opt out through the FGTS app, provided you have no contracted advance loan. The change only takes effect on the first day of the 25th month after the request — roughly two years later. During that period, you remain subject to the rule of withdrawing only the fine in case of dismissal without just cause.

What about advancing the birthday withdrawal?

An advance is a loan secured by the worker's future annual FGTS withdrawals; it is not an ordinary or free withdrawal. The credit rules need to be assessed separately:

  • Under the standard rules, the blocked FGTS balance may be calculated from the balance needed to generate the pledged withdrawal, rather than only the loan amount. Special collateral treatment under MP No. 1,355/2026 applied only to qualifying existing contracts active on May 4, 2026.
  • Since November 2025, a worker must wait 90 days after opting into birthday withdrawal before authorizing the FGTS balance check and blocking required to secure a new advance.
  • Through October 31, 2026, up to five annual withdrawals may be advanced. From November 1, 2026, the limit is reduced to three, subject to the other requirements.
  • An advance may be between R$ 100 and R$ 500 per annual withdrawal. Only one loan can be linked to a given annual withdrawal, and new borrowing is subject to repayment conditions. The nominal maximum is R$ 2,500 across five annual installments through October 2026 and R$ 1,500 across three starting in November 2026, before loan costs.

Consult the FGTS rules for advance loans and compare the lender's total effective cost (CET), interest, term and blocked balance. Borrowing against future withdrawals can worsen indebtedness. How to make the withdrawal

The worker can opt in and check eligible amounts using the FGTS app. The standard birthday withdrawal is not a loan and does not require a fee to opt in. Payment dates and methods follow the FGTS calendar and the specific account circumstances. Consult the official FGTS instructions; some cases may require service at a CAIXA branch.

Direct comparison: birthday withdrawal vs. termination withdrawal

Criterion Birthday withdrawal Termination withdrawal (default)
Partial annual withdrawal Yes, in your birthday month No
Full balance on dismissal without just cause No (only the 40% fine) Yes
Return to the default mode From the first day of the 25th month after the switch request —
Best for Those who want annual liquidity and have job stability Those who prioritize emergency protection

Conditional verdict

  • It can make sense if you have a stable job, an established emergency fund, and want to use the money annually for a concrete goal.
  • It's probably not worth it if the FGTS is your main protection against unemployment, or if you plan to take recurring advances without evaluating the costs.

If the idea is to use the money to start investing, first understand how to start investing and the importance of an emergency fund — which, incidentally, the balance locked by the birthday withdrawal stops fully serving.

Common mistakes

  1. Opting in without understanding the balance lock in case of dismissal.
  2. Taking repeated advances, turning the benefit into continuous debt.
  3. Forgetting the ~25-month waiting period to switch back to the termination withdrawal.
  4. Treating the annual withdrawal as guaranteed extra income, without planning — if you want to organize that money, see financial goals: how to set them.

FAQ

Can I switch back to the termination-withdrawal mode at any time? You can request a switch through the FGTS app or a CAIXA branch if no advance loan is outstanding. The change only takes effect on the first day of the 25th month after the request, not immediately.

If I am dismissed, do I lose the FGTS money? No. The remaining balance stays in the FGTS account, subject to applicable yields and withdrawal rules, and may be withdrawn on future birthdays or under other legal grounds such as retirement, serious illness or eligible housing purposes. An ordinary dismissal while birthday withdrawal is in effect does not unlock the remaining full balance.

Is taking a birthday-withdrawal advance worth it? It is a loan with costs and collateral restrictions. Compare interest, CET and blocked FGTS balance. Where possible, planning purchases in advance may be a lower-cost alternative; see our guide to planning a large purchase.

Does the birthday withdrawal cost anything? Opting into the standard FGTS birthday withdrawal is not taking out a loan. By contrast, an advance carries interest and other charges shown in the lender's CET. Check withdrawal conditions and the current calendar through official FGTS channels.

Conclusion

The birthday-withdrawal mode exchanges the usual ability to access the FGTS balance after dismissal without just cause for partial annual withdrawals. Whether it makes sense depends on job stability and emergency savings outside FGTS. An advance loan is a separate borrowing decision and should be evaluated using its total effective cost (CET). The exceptional releases completed in 2026 did not alter the standard rules.
